Student Industry placement/Project Placement/Project Agreement

As part of our commitment to best practice for those organisations and businesses who offer opportunities to our students, we have developed a student agreement outlining the terms and conditions of the relationship for all parties, including the provider organisation, the student and Wintec.

Having these agreements in place will provide everyone with clear expectations and support regarding some of the following key areas:
The Provider will sign an agreement with Wintec: this will establish expectations, and outline what obligations they need to meet in having a student undertake their Industry placement/project Placement/project. It outlines basic requirements regarding supervision and support of the student while in their care, compliance with Industry Best Practice, a complaints process to follow should any issues arise and an obligation to comply with Health and Safety legislation, etc., in order for the student to be provided with a safe and supported work environment during the term of their placement.

The student will sign an agreement with Wintec: this will establish Wintec’s expectations regarding the student’s conduct while working with the Provider. It also provides a full explanation of the requirements of both the student and Wintec regarding treatment of confidential information while undertaking work for the Provider. 

The student will sign an agreement with the Provider: this will establish the conditions under which the student agrees to work with the Provider during the course of their Industry placement/project Placement/project, including standard of workmanship, handling of confidential information and ownership of Intellectual Property.

Below we have provided a summary of the terms as contained in the agreements, to assist with your understanding. If you require further clarification of these terms, we advise you to obtain independent legal advice. 

Provider Obligations – Key Principles
Provide the student with an appropriate placement opportunity
No remuneration is normally given or expected unless negotiated otherwise. 

Wintec Obligations – Key Principles
Provide academic supervision and guidance throughout the placement
Assess and/or moderate the placement once completed.

Liability 
No liability is accepted by either students or Waikato Institute of Technology if the student should fail to meet the expectations of the provider, and no warranty, express or implied, can be given about the suitability of any intern.  However we do endeavour to match interns with the industry provider in a robust manner.

Confidentiality
All information provided and/or disclosed to Wintec or the student by the provider will be kept in strict confidence as a trade secret by both Wintec and the student.

Intellectual Property 
Unless agreed otherwise in writing, any Intellectual Property related to the work of the student will be owned by the provider.

However, the provider will allow Wintec’s supervising lecturer access to the student’s completed documentation for assessment and moderation purposes only.  Providers will also approve materials for use in a public display (related to assessment). Students may reference the placement in their curriculum vitae.

Health and Safety Requirements
In order to meet the requirements of the Health and Safety in Employment Act 1992 and 2002 Amendments, providers may be asked for information and assurances that show that health and safety issues for students are appropriately managed.

Supervision
Each project is supervised by a CFIT (Centre for Information Technology) lecturer. The supervisor’s task is to give guidance on quality expectations (standards of behaviour with clients, documentation standards, etc.) and to advise on issues as the Placement develops. The supervisor may also give guidance to students on where to look for additional support and how to go about some tasks. 

Signing the Student Industry Agreements
You will be provided with two originals of each agreement. When you are satisfied with the terms and conditions, please sign and return the agreements to Alison Marshall (CFIT Industry Relationship Manager).  Alison can be contacted on alison.marshall@wintec.ac.nz or 07 8348800 x 3444

Providers – Please ensure that you have read and understood the Student Industry Agreement labelled Wintec/Provider and Provider/Student; once you are satisfied with the agreements please sign both agreements and provide back to the Programme Advisor. The Wintec Contracts Office will ensure that you are provided with one of the signed originals for your records. 
Students – Please ensure that you have read and understood the Student Industry Agreement labelled Wintec/Student and Provider/Student; once you are satisfied with the Agreements please sign both agreements and provide back to the Programme Advisor or your academic supervisor. The Wintec Contracts Office will ensure that you are provided with one of the signed originals for your records.

Please note that Providers will normally deal directly with students and supervisors over all matters concerning the Placement, once the Agreements are signed.  The Industry Relationship Manager may become involved in any problems or disputes.
